Concerns Addressed by Nevada Secretary of State Francisco Aguilar?

Nevada Secretary of State Francisco Aguilar recently replied to election integrity concerns expressed by Committee on House Administration Chairman Bryan Steil (R-Wis.), saying, “Americans may rest assured that Nevada will continue to run some of the most secure, accessible, and fair elections in the country.

Absence of Widespread Voter Fraud?

According to Cisco Aguilar, “There is no evidence of widespread voter fraud in Nevada, at any point in our state’s history.

Constitutional Challenges to Electronic Voting Systems

Mr. Aguilar’s confidence in Nevada’s elections is not reflected in the public’s trust. He has not dispelled public concerns about electronic voting and tabulating systems, or voter registration either. For if he had or did, he could counter the assertions as set forth in Curling v. Raffensperger, where the judge ruled that the mode of implementation of Dominion Voting Systems in Georgia created an imminent risk of violation of voter’s 1st and 14th Amendment rights. Embedded Malware and Vulnerabilities

Details of embedded malware in Dominion systems that surpasses logic and accuracy testing were presented to the Georgia Board of Elections by petitioners Moncla and Cross: “… the erroneous code and errors both survived Logic and Accuracy Testing across seven tabulators. Lastly, if the “erroneous code” was not due to malware and was a mistake by Dominion’s programmers, then how did it survive certification testing?”

Details of seditious software code that opens election equipment to indiscriminate user manipulation offered to the U.S. Supreme Court in Lake and Finchem v. Fontes, ““…the master cryptographic encryption keys that are used to govern and encrypt all election data had been left open on the database in plain text,” leaving it vulnerable to tampering.”

Electronic Poll Books are also part of the election infrastructure, which the judge in Curling determined: “Because the voter registration database and electronic pollbooks could be accessed over the Internet, the SSCI report considered them to be “vulnerable components of U.S. election infrastructure.” In Curling, at issue are “cybersecurity deficiencies that unconstitutionally burden Plaintiffs’ First and Fourteenth Amendment rights.”

Historical Election Frauds

Mr. Aguilar’s historical knowledge is questionable as many races in the state’s history were allegedly marred by election fraud of one kind or another. For example, Storey County experienced voter bribery and an influx of voters who were non-residents, with no ID for decades starting in the 1960s.

According to Harry Reid associate Don Williams, “[Joe] Conforte also took me out to his car one time and showed me a whole trunk of absentee ballots filled out for Harry.” Harry: Mob, Money, and Influence, by Daxton Brown, 5th Ed., p. 14.

Digital Age Manipulations

Those were old school ways to manipulate elections. In the digital age, it all happens inside the coding and the transmission of data to which the general public is unaware and uninformed. As white hat election cyber expert Mark Woods explained: @00:16:44 “Any intelligent person that’s skilled can get into and manipulate any of these systems and no one would ever know it, not even the election officials that are using it, sitting in front of it, they wouldn’t have a clue either.”

 

Evidence of Issues in Nevada

In fact, there is so much evidence out there indicating that voter registration, electronic check-in, voting, and tabulating are fraught with vulnerabilities and inaccuracies that it’s a wonder Cisco Aguilar is not more proactive in proving his assertion that Nevada is immune to similar issues.

Cisco Aguilar’s attitude is ‘Trust the Science™’ : If it’s not proven to exist in Nevada then it does not exist.

This goes to the core of voter trust and confidence and the lack thereof.

Yet, there is evidence about Nevada: (not comprehensive)

  • Pattern vote allocation across precincts statewide; malware.
  • Abnormally high turnout rates in the Washoe County 2020 general, some precincts exceeded 100% turnout, many others above 90%; ballot stuffing.
    In Washoe County post-primary from June to August 2022, a sharp drop of -27,698 (-8.78%) active registered voters from 315,376 to 287,678. Followed by a pre-general pop from August to November of 24,435 (8.49%) from 287,678 to 312,113. Followed by a culling of -12,722 (-4.06%) from December to January from 313,039 to 300,317. High incidence of duplicate (83%) and invalid (50%) voter registrations in Washoe County compared to Nevada, along with a low incidence in Clark County of duplicate (2.95%) and invalid (34.16%) though Clark County handled 4.3 times the number of total registered forms in 2022 general compared to Washoe County. Why is Clark County so low?
  • Inactive voters have ballooned statewide up 76.38% between 2020 and 2022 from 203,761 to 359,403.
  • The inability of the ERIC system to weed out dead persons, moved aways, and non-citizens and/or non-residents; part of the cause of the above statistics.
  • A lack of understanding of numbers of ineligible voters and ballots in the system, only cursory statistics gathered. No statistics on Fake IDs, missing IDs, forgeries, false documents, bogus name variations, and the like.
  • Sworn testimonials of individuals who moved out-of-state and claimed to have not voted in Nevada but were recorded as having done so.

All of this paints a pattern of voter roll manipulations in conjunction with  machine/software voting and tabulating manipulations.

Challenges to Nevada Voter Confidence

Whatever shred of voter confidence Cisco Aguilar enjoyed before the Preferential Presidential Primary evaporated when the whistle was blown on the mail ballot glitch caused by the rushed implementation of the VREMS Project. The glitch involved being counted as having voted by mail when no such ballot had been requested or cast by the voter. Mr. Aguilar unilaterally decided to damn the torpedoes and ram the VREMS onto counties despite warnings and complaints.

He demanded $45 million to do it, along with other upgrades. And now we have two systems: ERIC and the VREMS. Why are we supporting ERIC at this point and when will it go away?

Cisco Aguilar owns this amazing embarrassment for which his solution is to double-down with platitudes about how great everything is. Don’t trust your senses, he implies.

If Nevadans knew the truth, they would vociferously demand an immediate halt to use of electronic voting and tabulating systems, followed by a full and complete forensic audit of our elections.

The rush toward technology by Cisco Aguila is wanton and reckless, expending tax dollars on systems and solutions that are not secure and should not be used.

Call for Reform no later than August 1, 2024

For the security and accuracy of elections—and to restore voter confidence—casting a ballot should be with a black ballpoint pen on paper at the precinct polling location, and to make them as accessible as possible. The most secure, accurate, and immediate way to count ballots cast at the polls is to count them at the polls. With these tried-and-true procedures, for which there is no legal impediment to enacting them, elections will be more uniform, accurate, trusted, and affordable.
